Welcome to Flex EV Mobility Services Private Limited ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our electric scooter rental services and website. By accessing or using our services, you agree to comply with and be bound by these Terms. If you do not agree, please do not use our services.

 

1. Eligibility and Documentation

To qualify for a rental, the Rider ("you") must:

  • Be at least 18 years old.

  • Possess a valid driving license if the vehicle is RTO-registered.

  • Submit a valid government-issued ID for non-RTO vehicles (where no license is required).

  • Be actively registered with a delivery company (e.g., Zomato, Swiggy, Porter, etc.).

  • Provide accurate contact, emergency, and employment details.

  • Consent to background checks, including criminal verification if requested.
     

2. Rental Agreement

2.1 Scooter Usage

You agree to operate the electric scooter in a responsible manner and strictly adhere to all applicable local, state, and national laws and traffic rules.

2.2 Rental Period

The rental period shall begin at the time of handover and last for a minimum duration of three (3) months. Early termination by the Rider results in forfeiture of the entire booking amount.

2.3 Booking Charges

The Rider shall pay a booking amount comprising:

  • ₹1,000 refundable if the full 3-month term is completed and the vehicle is returned in acceptable condition.

  • A non-refundable portion (amount communicated during onboarding) retained as a booking fee.

  • The entire booking amount is non-refundable if the Rider returns the vehicle before the completion of the rental term.
     

 

3. Monthly Rent and Security Deposit

Rental charges vary based on the vehicle model and battery type (standard/high-capacity). These rates are communicated during onboarding.

A refundable security deposit must also be paid:

  • BatterySmart/Submobility: ₹3,500

  • Ola: ₹4,500
     

This deposit is refundable upon vehicle return, subject to no damage, theft, or breach of agreement terms.

4. Payment Terms

  • Rent must be paid weekly/monthly in advance via UPI, bank transfer, or other approved methods.

  • Late payments incur a fee of ₹100/day.

  • Non-payment beyond 5 days may result in termination, vehicle repossession, and additional penalties.
     

 

5. Vehicle Handover and Return

  • Handover will be documented in a signed inspection report.

  • Upon return, the vehicle must be in similar condition (reasonable wear and tear allowed).

  • Any damages, missing parts, or non-functional components will be assessed and deducted from the security deposit.
     

 

6. Maintenance and Repairs

  • Routine servicing will be provided by us at authorized centers.

  • You must report any mechanical issues or abnormal noise immediately.

  • Damages caused by negligence, overloading, misuse, or unauthorized modifications will be fully borne by the Rider.

  • Cleanliness and general upkeep are your responsibility.
     

 

7. Use Restrictions and Penalties

You agree NOT to:

  • Use the vehicle for unauthorized passenger transport or illegal activities.

  • Sublet or allow others to use the vehicle

  • Perform stunts, races, or drive recklessly.

  • Carry illegal items, narcotics, or participate in crimes.
     

Violation may result in:

  • Immediate termination of the agreement.

  • A penalty up to ₹10,000.

  • Legal action, including police complaints.
     

8. Geographic Restrictions

  • Vehicle usage is restricted to city limits unless written approval is granted.

  • Unauthorised travel outside the permitted area will incur a penalty of ₹50/day.

9. Theft, Loss, and Reporting Obligations

In case of theft, accident, or incident, the Rider must:

  • Immediately notify us and file an FIR at the local police station.

  • Cooperate in the investigation and submit all necessary documents.

  • Be fully liable for any theft, loss, or damage (especially battery theft, which is not always covered by insurance).
     

Reportable incidents include:

  • Vehicle or battery theft

  • Fire or explosion

  • Third-party collisions

  • Rider/pillion injury or fatality

  • Goods theft (from/by Rider)
     

The Rider must bear full replacement costs if insurance does not cover the loss.

10. Legal Liabilities and Indemnity

The Lessor shall not be liable for any incidents, accidents, crimes, or disputes caused by or involving the Rider. These include but are not limited to:

  • Injury or death of a pillion or third party

  • Criminal involvement of the Rider or asociates

  • Theft, snatching, or misbehavior

  • Damages or loss due to Rider’s negligence

  • Rider having pre-existing criminal charges
     

The Rider shall indemnify and hold harmless Flex EV Mobility Services Pvt. Ltd. and its officers from all resulting claims, legal costs, fines, or losses.

11. Force Majeure

Neither Party shall be liable for any delay or failure due to circumstances beyond their control, including but not limited to natural disasters, war, pandemic, government restrictions, or strikes.

 

12. Termination of Agreement

The Agreement may be terminated under the following conditions:

  • Completion of the agreed rental term

  • Voluntary return of the vehicle in good condition

  • Breach of any clause by the Rider

  • Use of the vehicle for illegal or unauthorized activity
     

We reserve the right to terminate the agreement without notice if criminal activity or threats to safety/property are involved.

13. Dispute Resolution and Jurisdiction

This Agreement shall be governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts located in Delhi.

Eligibility and Documentation

To qualify for the rental, the Rider must meet the following criteria:

  • Be at least 18 years old.

  • Possess a valid driving license if the rented two-wheeler is RTO-registered.

  • Submit a government-issued ID if renting a non-RTO vehicle (where a license is not compulsory).

  • Be actively registered with a delivery company such as Zomato, Swiggy, Porter, or equivalent.

  • Provide accurate contact information, emergency contact, and employment details.

  • Consent to background checks, including criminal verification if required.

 

3. Rental Term and Booking Charges

The minimum duration of the rental agreement shall be three (3) months. The Rider shall pay a booking charge of ₹ security_deposit, which shall include:

  • A refundable amount of ₹1,000, payable only if the Rider completes the full 3-month rental period and returns the vehicle in acceptable condition.

  • A non-refundable portion of ₹ non_refundable, to be retained by the Lessor as booking fees.

  • In the event the Rider returns the vehicle before the completion of 3 months, the entire booking amount shall be forfeited, and no refund will be provided.

 

4. Monthly Rent and Security Deposit

The monthly rental amount will depend on the type of vehicle and the installed battery (e.g., standard or high-capacity). These rates shall be communicated in writing at the time of onboarding.

The Rider shall also deposit a refundable security deposit, determined as follows:

  • BatterySmart/Submobility – ₹ 3500 /- 

  • Ola – ₹ 4500 / -

This security deposit mentioned as above with terms and condition shall be refunded upon return of the vehicle, provided there is no damage, theft, or violation of the agreement terms.

 

5. Payment Terms

The Rider shall pay the weekly/monthly rent in advance, on or before the due date each week. Payment shall be made through UPI, bank transfer, or another approved method determined by the company. Delayed payment beyond the due date shall attract a late payment fee of ₹100 per day which will be recovered by the company. 

Failure to pay rent for more than 5 days from the due date may lead to termination of the agreement and repossession of the vehicle along with penalty as determined by the company.

 

6. Vehicle Handover and Return

The vehicle will be handed over to the Rider in good working condition, as documented in the vehicle handover sheet signed by both Parties.

At the time of return, the vehicle must be inspected again and returned in a condition similar to its original state, subject to reasonable wear and tear. Any damages, dents, missing or non-functional parts (e.g., mirrors, lights, panels, battery, wiring) will be assessed, and the corresponding amount will be deducted from the security deposit.

 

7. Maintenance and Repairs

Routine servicing of the vehicle will be conducted by the Lessor at authorized service centers. The Rider must immediately report any technical issue, breakdown, or unusual noise.

Any damage due to negligence, overloading, misuse, off-road driving, waterlogging, or unauthorized modifications shall be borne entirely by the Rider. The Rider is also responsible for the cleanliness and general upkeep of the vehicle.

 

8. Use Restrictions and Penalties

The Rider agrees not to:

  • Use the vehicle for unauthorised passenger transport or illegal delivery.

  • Sublet or lend the vehicle to another person.

  • Perform stunts, racing, or reckless driving.

  • Transport illegal items, narcotics, or engage in criminal activity.

In case of any such misuse, the Lessor reserves the right to:

  • Terminate this agreement with immediate effect.

  • Impose a penalty of up to ₹10,000.

  • File a police complaint or take legal action, as required.

 

9. Geographic Restrictions

The vehicle is strictly to be used within the city limits unless written approval is obtained from the Lessor in advance.

If the Rider is found to have taken the vehicle outside the permitted area without permission, a penalty of ₹ 50 per day shall be imposed.

 

10. Theft, Loss, and Reporting Obligations

In the event of theft, accident, or serious incident involving the vehicle, the Rider must:

  • Immediately inform the Lessor and lodge a First Information Report (FIR) with the local police station.

  • Cooperate in investigations and provide all necessary documentation.

  • Be liable for any loss or damage to the vehicle, including the battery.

Typical reportable mishaps include:

  • Vehicle theft

  • Battery theft or damage

  • Fire, short-circuit, or explosion

  • Third-party collision

  • Rider or pillion injury or fatality

  • Theft of goods from or by the Rider

The Rider shall bear the full replacement cost of the battery or scooter if stolen, and the insurance (if applicable) does not cover it.

 

11. Legal Liabilities and Indemnity

The Lessor shall not be held responsible or liable for any accident, injury, crime, or civil dispute arising from the Rider’s actions. This includes but is not limited to the following scenarios:

  • A pillion rider is injured, dies, or is involved in a criminal case.

  • Third-party injury or property damage in an accident.

  • The Rider is involved in theft, snatching, or illegal delivery.

  • The Rider misbehaves, abuses, or harasses any third party.

  • The Rider lends the vehicle to another person who commits a crime.

  • The Rider is murdered while using the vehicle.

  • The Rider commits a murder or other criminal offense.

  • The Rider has pre-existing legal cases or criminal charges.

  • Battery or other components are stolen due to the Rider’s negligence.

The Rider shall indemnify and hold harmless the Lessor and its directors from all claims, suits, losses, fines, legal costs, and liabilities arising from any such event.

 

12. Force Majeure

The Parties shall not be liable for any delay or failure in performing their obligations under this Agreement due to events beyond their control, including but not limited to natural disasters, pandemics, wars, strikes, or government restrictions.

 

13. Termination of Agreement

This Agreement shall terminate automatically upon:

  • Completion of the agreed rental term (if not renewed).

  • Return of the vehicle in good condition.

  • Breach of any clause by the Rider.

  • Use of vehicle in any criminal or unauthorized activity.

The Lessor may also terminate this Agreement without notice in cases involving illegal activity or endangerment of life or property.

 

14. Dispute Resolution and Jurisdiction

This Agreement shall be governed by the laws of India. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in Delhi.

 

15. Notices

All notices, requests, or communications under this Agreement shall be given in writing via registered phone, email or physical address mentioned herein.
